New rules in Ontario requiring all-in price advertising for travel services

Effective January 1, 2017, travel advertisements in Ontario must be inclusive of all taxes, levies, fees and other charges, when advertising travel services. This requirement applies to any advertisement made by a registered travel agent or wholesaler that refers to the price of travel services, including any online, radio, television or print advertising.

The last review of the Travel Industry Act (Ontario) (the “Act“) was in 2002. Given the increase use of online services to book travel and home-sharing services (e.g. Airbnb),  Ontario is considering further amendments in relation to consumer protection for travelers and is beginning a consultation process in February 2017 ( ontario.ca/TravelActReview). The Act governs and sets standards for all travel retailers and travel wholesalers in the Province of Ontario.
